href=\"https:\/\/www.bdo.ca\/insights\/canadian-snowbirds-and-u-s-property-investors-what-you-need-to-know#:~:text=With%20no%20precise%20government%20statistics,own%20their%20own%20U.S.%20real\" While it\u2019s easy for Canadians to get to the U.S., there are tax and immigration rules to be aware of if you want to stay for an extended period of time. To keep you informed and protected against unpleasant surprises, here are seven things you may want to consider should you plan to work, visit and stay in the U.S. as a Canadian.<\/p>\n\n\n\n<p>Please note that the following information is for reference purposes only and not professional tax advice. For expert tax advice specific to your individual situation, contact a tax professional.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">1. Understand U.S. immigration rules<\/h2>\n\n\n\n<p>U.S. Immigration rules state that if you\u2019re a Canadian resident, you can\u2019t spend more than 182 days in the U.S. per year (that\u2019s a 365-day rolling year, not a calendar year). If you go over that amount, there are a number of consequences you might contend with:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-rbc-list default is-style-blue-disc\">\n<li class=\"wp-block-rbc-list-item\">\n<p><strong>Unlawful presence:<\/strong>&nbsp;You could be considered an illegal resident of the U.S. and be banned from the country for 3-10 years.&nbsp;<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p><strong>Estate tax exposure<\/strong>: The U.S. imposes estate tax on your worldwide assets if you\u2019re considered a U.S. resident at the time of death.&nbsp;<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p><strong>Canadian departure tax:<\/strong>&nbsp;When you cease being a Canadian resident for tax purposes, the Canadian government can charge a&nbsp;<a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/tax\/international-non-residents\/individuals-leaving-entering-canada-non-residents\/leaving-canada-emigrants.html#dptx\" target=\"_blank\" data-dig-id=\"LP-57686-b611d9ea\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"departure tax\" rel=\"noreferrer noopener\" class=\"rbc-link-format\">departure tax<\/a>&nbsp;(also known as a deemed disposition tax) on accrued gains on many of your assets.<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p><strong>Healthcare coverage:<\/strong>&nbsp;Losing your Canadian residency by staying for too long in the U.S. would likely affect your Canadian health care and coverage.<\/p>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">2. Understand U.S. tax rules<\/h2>\n\n\n\n<p>Unfortunately, spending less than 182 days in a given year does not automatically clear you from being considered a U.S. resident and having to file a U.S. tax return to the IRS.&nbsp;<\/p>\n\n\n\n<p>Unlike U.S. immigration rules, the amount of time you can stay in the U.S. without a tax penalty isn\u2019t based on a set number of days every year. Rather, you need to consider time spent in the U.S. over the last three years. This is where the substantial presence test comes in.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Know how the substantial presence test works<\/h2>\n\n\n\n<p>The&nbsp;<a href=\"https:\/\/www.irs.gov\/individuals\/international-taxpayers\/substantial-presence-test\" target=\"_blank\" data-dig-id=\"LP-57686-41046317\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"substantial presence test\" rel=\"noreferrer noopener\" class=\"rbc-link-format\">substantial presence test<\/a>&nbsp;is a formula you could use to help determine if you\u2019re spending too many days in the U.S. for tax purposes. It\u2019s based on how many days you have spent in the U.S. over a 3-year period, including the current calendar year and the previous two calendar years.&nbsp;<\/p>\n\n\n\n<p>The formula looks like this:<\/p>\n\n\n\n<ul class=\"wp-block-rbc-list default is-style-blue-disc\">\n<li class=\"wp-block-rbc-list-item\">\n<p>Add all the years you spent in the U.S. in the current calendar year, and<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>1\/3 of the days you spent in the U.S. last year, and<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>1\/6 of the days you spent in the U.S. in the year prior to last year<\/p>\n<\/li>\n<\/ul>\n\n\n\n<p>If the total equals at least 183 days, you would meet the substantial presence test and be considered a U.S. resident for tax purposes in the current year (and may be subject to tax payments to the IRS).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. There are calculators to help<\/h2>\n\n\n\n<p>Don\u2019t want to do the math, or want to make sure you\u2019ve calculated things correctly? And if you meet the substantial presence test? Go to plan B<\/h2>\n\n\n\n<p>If your calculations put you over 182 days \u2014 but your connections are much closer to Canada than they are to the U.S. \u2014 you may be able to avoid paying taxes in the U.S.<\/p>\n\n\n\n<p>With the&nbsp;<a href=\"https:\/\/www.irs.gov\/individuals\/international-taxpayers\/conditions-for-a-closer-connection-to-a-foreign-country\" target=\"_blank\" data-dig-id=\"LP-57686-fcf2f9cc\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"closer connection exception\" rel=\"noreferrer noopener\" class=\"rbc-link-format\">closer connection exception<\/a>, you may be eligible to spend up to 182 days in the U.S. per calendar year as long as you prove that you have closer ties with Canada. The U.S. government looks at a number of factors in determining if you qualify for this exception, such as where your home and family are located.<\/p>\n\n\n\n<div class=\"wp-block-rbc-rbc-default-collapsible  mar-t\"><p><button class=\"collapse-toggle collapsed\" data-target=\"#collapse16fe1ff3\" data-toggle=\"collapse\" aria-expanded=\"false\" aria-controls=\"collapse16fe1ff3\" data-dig-id=\"LP-57686-16fe1ff3\" data-dig-category=\"LP\" data-dig-action=\"accordion closed\" action-closed=\"accordion closed\" action-opened=\"accordion open\" data-dig-label=\"Factors that may help demonstrate your closer connection is to Canada\"><div>Factors that may help demonstrate your closer connection is to Canada<\/div><\/button><\/p><div class=\"collapse-content collapse\" id=\"collapse16fe1ff3\">\n<div class=\"wp-block-rbc-collapsible-inner-block collapse-inner\"><\/div>\n\n\n\n<div class=\"wp-block-rbc-collapsible-inner-block collapse-inner\">\n<ul class=\"wp-block-rbc-list default is-style-blue-disc\">\n<li class=\"wp-block-rbc-list-item\">\n<p>Your permanent home is in Canada<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>Your family is located in Canada<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>Your business activities are carried on in Canada<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>You own personal property in Canada such as a car, furniture, jewelry<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>You hold a Canadian driver\u2019s license<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>You have memberships in social organizations in Canada<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>You are registered and vote in Canada<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>You belong to religious, political or cultural organizations in Canada<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>You have a bank account in Canada<\/p>\n<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-rbc-collapsible-inner-block collapse-inner\">\n<p>To qualify for this exception, you have to file&nbsp;<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8840.pdf\" data-dig-id=\"LP-57686-e965dd30\" data-dig-label=\"Form 8840\" data-dig-action=\"link click\" data-dig-category=\"LP\" class=\"rbc-link-format\">Form<\/a><a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8840.pdf\" target=\"_blank\" data-dig-id=\"LP-57686-e965dd30\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"Form 8840\" rel=\"noreferrer noopener\" class=\"rbc-link-format\"> <\/a><a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8840.pdf\" data-dig-id=\"LP-57686-e965dd30\" data-dig-label=\"Form 8840\" data-dig-action=\"link click\" data-dig-category=\"LP\" class=\"rbc-link-format\">8840<\/a>&nbsp;with the IRS every year before June 15<sup>th<\/sup>.<\/p>\n<\/div>\n<\/div><\/div>\n\n\n\n<p>To qualify for this exception, you must file&nbsp;<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8840.pdf\" target=\"_blank\" data-dig-id=\"LP-57686-8eef1fe2\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"Form 8840\" rel=\"noreferrer noopener\" class=\"rbc-link-format\">Form 8840<\/a>&nbsp;with the IRS every year before June 15<sup>th<\/sup>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. And if you don\u2019t qualify for the exception? All is not lost!<\/h2>\n\n\n\n<p>If you\u2019re not eligible for the closer connection exception, you may still be able to apply for a tax exemption under the&nbsp;<strong>Canada-U.S. Tax Treaty<\/strong>. One of the main goals of the treaty is to prevent double taxation of Canadian taxpayers, so there are some tiebreaker rules set up to determine whether you should be paying tax in Canada or the U.S.<\/p>\n\n\n\n<div class=\"wp-block-rbc-rbc-default-collapsible mar-t\"><p><button class=\"collapse-toggle collapsed\" data-target=\"#collapse8c4ad22e\" data-toggle=\"collapse\" aria-expanded=\"false\" aria-controls=\"collapse8c4ad22e\" data-dig-id=\"LP-57686-8c4ad22e\" data-dig-category=\"LP\" data-dig-action=\"accordion closed\" action-closed=\"accordion closed\" action-opened=\"accordion open\" data-dig-label=\"Canada-U.S. Tax Treaty Tiebreaker Rules\"><div>Canada-U.S. Tax Treaty Tiebreaker Rules<\/div><\/button><\/p><div class=\"collapse-content collapse\" id=\"collapse8c4ad22e\">\n<div class=\"wp-block-rbc-collapsible-inner-block collapse-inner\"><\/div>\n\n\n\n<div class=\"wp-block-rbc-collapsible-inner-block collapse-inner\">\n<p>The tiebreaker rules are applied on a hierarchical basis, starting with the first factor. So, if that factor doesn\u2019t solve anything, you may continue to move on to the second factor and so on.<\/p>\n\n\n\n<ul class=\"wp-block-rbc-list default is-style-default\">\n<li class=\"wp-block-rbc-list-item\">\n<ol class=\"wp-block-rbc-list\">\n<li class=\"wp-block-rbc-list-item\">\n<p>Is there a permanent home available to you in Canada or the U.S.? &nbsp;<\/p>\n\n\n\n<p><em>If you have a permanent home available for your use in both countries, you may have to look at the second tiebreaker rule&nbsp;<\/em><\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>In which country do you have closer personal and economic relations?&nbsp;<\/p>\n\n\n\n<p><em>For instance, is your family located in Canada? Are you carrying on a business in Canada? Are your bank accounts and social memberships in Canada? Are you registered and vote in Canada?<\/em><\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>In which country do you typically live?<\/p>\n<\/li>\n\n\n\n<li class=\"wp-block-rbc-list-item\">\n<p>Which country are you a citizen of?<\/p>\n<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<\/div>\n<\/div><\/div>\n\n\n\n<p>To claim the treaty exemption, it\u2019s typically required to file a&nbsp;<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f1040nr.pdf\" target=\"_blank\" data-dig-id=\"LP-57686-26b3588d\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"U.S. non-resident tax return (1040NR)\" rel=\"noreferrer noopener\" class=\"rbc-link-format\">U.S. non-resident tax return (1040NR)<\/a>&nbsp;and attach a treaty exemption statement (<a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f8833.pdf\" target=\"_blank\" data-dig-id=\"LP-57686-57901e0e\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"Form 8833\" rel=\"noreferrer noopener\" class=\"rbc-link-format\">Form 8833<\/a>), which indicates you are a resident of Canada under the treaty.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. You can track your border crossings online<\/h2>\n\n\n\n<p>If you haven\u2019t been keeping close track of how long you\u2019ve been spending in the U.S. over the last few years, not to worry. Canada and the U.S. share information about when you enter and leave each country and the Canada Border Patrol provides&nbsp;<a href=\"https:\/\/i94.cbp.dhs.gov\/I94\/#\/home\" target=\"_blank\" data-dig-id=\"LP-57686-5fd753e6\" data-dig-category=\"LP\" data-dig-action=\"link click\" data-dig-label=\"online access\" rel=\"noreferrer noopener\" class=\"rbc-link-format\">online access<\/a>&nbsp;to a report of your border crossings. To access the information, have your passport handy, and you\u2019ll need to enter a few details from it.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Bottom line<\/h3>\n\n\n\n<p>You may want to consider spending fewer than 182 days per 365-day period in the U.S. to avoid being considered a U.S. resident for income tax purposes.
