Terms of Use for the KONEK Service

These Terms of Use (“Terms”) apply when you use the “KONEK Service” (also referred to as the “Service”) provided by Interac Corp. (“Interac”) to make a payment for a purchase using a Payment Method (as defined below) that we make available to you using the KONEK Service. Please read these Terms carefully. These Terms are a legal agreement between you and Royal Bank of Canada (RBC). If you add, activate or use a Payment Method in the KONEK Service, it means that you accept and agree to these Terms.

The KONEK Service facilitates the fulfillment of transaction payments through an Interac-branded gateway (the “KONEK Gateway” or “KONEK”) by allowing you (also referred to as the “customer”) to pay for purchases made online or through electronic or mobile applications using: (a) an eligible RBC Visa credit card or RBC Mastercard credit card, (b) the Interac Direct Service operated by Interac Corp. that allows you to make payments directly from your eligible RBC eligible account ("Interac Direct"); (c) your RBC Virtual Visa Debit using funds from your primary RBC chequing account; or (d) any other eligible payment methods (each, a “Payment Method”) offered by us and other Canadian financial institutions.

References in these terms to the Konek Gateway, Konek Service or Interac Direct includes features, functionality, and services that are either currently available or to be available in the future. Any changes to the Konek Service may result in a corresponding change to [Interac Direct or] the [other] Payment Methods that are available through the Konek Gateway.

Definitions: The words “you” and “your” mean you, as a customer of RBC, and the words “we”, “us”, and “our” mean RBC.

  • Additional Third Party Terms

Parts of the KONEK Service that can be used or accessed by you are products and/or services by third party service providers. By adding, activating or using an RBC Payment Method in the KONEK Service, you are also agreeing to any third party terms and conditions of use that apply to your use of the KONEK Service with your Payment Method, such as agreements you may have with your wireless carrier, agreements you may have with Vendors to whom you make payments, and Interac’s KONEK Terms of Use and Interac’s KONEK Privacy Policy (the “Third Party Terms”).

Furthermore, when you use the KONEK Service, your chosen Payment Methods are still subject to the applicable account, privacy and other agreement(s) between you and us (“Account Documents”).

If there is a conflict between a term in the Account Documents and these Terms, the Account Documents will prevail to the extent necessary to resolve the conflict.

  • Using the KONEK Service.

You can choose your Payment Method for use in the KONEK Service from any participating financial institution, including us. The availability of certain Payment Methods may be limited due to factors outside of our control, including requirements or limitations imposed by the merchant you are purchasing from, a payment network (e.g., Visa, Mastercard, or Interac) or the acquirer for the merchant (an acquirer facilitates the processing of payments between us and your merchant). There may also be other times when your preferred Payment Method cannot be used, for example, if your credit card has expired, you no longer have access to the eligible account you selected, or a Payment Method is not in good standing (including if you are past due on payments or have overlimit/ overdraft on it).

You authorize us, directly or through third parties, to make any inquiries we consider necessary to facilitate your use of the KONEK Service (including to detect potential fraud, illegal activities or to ensure our compliance with applicable laws), or that may be required by applicable law or law enforcement agencies.

You agree that you will not: (1) use the KONEK Service for any purpose other than purposes permitted by us in these Terms; (2) reverse engineer, disassemble, decompile, unlock, recreate, modify, copy, license, sublicense, create derivative software from, sell, rent, lease, loan, distribute, reproduce, display or transfer any of the KONEK Gateway, or any part thereof, other than as permitted herein; (3) send or store malicious code, infringing or unlawful material to or on Interac software or the KONEK Gateway; (4) attempt to gain unauthorized access to, or disrupt the integrity or performance of, any part of the KONEK Gateway, or any data contained therein, or any systems, equipment or networks connected to the KONEK Gateway; (5) circumvent or disclose the user authentication information or security of the KONEK Gateway, or any host, network, or account related thereto; (6) send personal information in any fields not specified for personal information; (7) make any use of the KONEK Services that violates any law, for illegal, fraudulent or dishonest purposes; or (8) utilize any automated or manual system to access or to test the KONEK Services production environments. In providing the KONEK Services, we must comply with all Payment Network Rules in connection with your use of the KONEK Gateway. “Payment Network Rules” are the applicable bylaws, rules, bulletins, regulations, documentation, manuals and similar requirements effected or adopted for each payment network (e.g., Interac, Visa, or Mastercard, each a (“Payment Network”)) and as may be amended, supplemented or restated from time to time.

  • Applicable Fees and Interest; Limits.

We do not currently charge you any fees when you use the KONEK Service. However, other third parties, such as wireless companies or data service providers, may charge you service fees in connection with your use of your electronic or mobile device, the applicable Payment Method or the KONEK Service, and they are not reimbursable by RBC. All interest, fees and other charges applicable to your chosen Payment Method continue to apply to all transactions made through the KONEK Service using that Payment Method. Please consult your Account Documents for information on interest rates, fees and other charges.

We, Payment Networks or merchants may establish transaction limits from time to time in our discretion relating to your use of the KONEK Service. We may also not allow you to use the KONEK Service if you would exceed your credit limit on an eligible credit card, or your use of the Interac Direct and/or Virtual Visa Debit (VVD) payment method will cause you to exceed the daily transaction limit on your eligible personal chequing account. This may mean that you are unable to use the KONEK Service to complete a transaction that exceeds these limits.

  • Keeping your Credentials Secure.

We are not responsible for the performance or security of the KONEK Service. You are responsible for keeping your KONEK and RBC Online and Mobile user identification, passwords, passcodes, biometric data and all other credentials (the “Credentials”) private and secure. When using the KONEK Service, you will secure your device with the same care you would your chosen Payment Method in order to avoid unauthorized use of your chosen Payment Method(s). Entering your Credentials may be required when you access the KONEK Service from a device. You must not disclose your Credentials to anyone. We will not be responsible for any losses associated with you sharing your Credentials. You understand that by enabling the KONEK Service, to make payments using your chosen Payment Method(s) your device in certain instances will act as if it were your payment card. If your device is lost or stolen, or your Credentials are compromised, or if you become aware of any unusual, suspicious or fraudulent activity for your chosen Payment Method connected to the Konek Service, you agree to immediately notify us by calling 1-800-769-2536.

We may take these actions at any time, without telling you first, and for any reason, including if you fail to comply with these Terms, any of the other Third-Party Terms or your Account Documents, if we suspect fraud, if your account associated with your Payment Method is not in good standing, there is a change in applicable law or for other reasons we determine.

The only exception to this is if we are negligent as compared to reasonable commercial standards, subject to the exclusions set out below. For clarity, nothing in this section affects Our Responsibility for Unauthorized Transactions (section 6).

No Liability Even if we are Negligent: We will not be liable to you, even if we are negligent, for any loss, damages, delay, or inconvenience to you for any: (1) losses related to your failure to do something, including a failure to meet your obligations under these Terms; (2) mistakes, errors, omissions, inaccuracies or other inadequacies of, or contained in any data or information, including as a result of a failure to update data or information; (3) actions or failures to act by any third party; (4) delay, error, interruption or failure by us to perform or fulfill any of our obligations to you due to any cause beyond our control, any system malfunctions or any technical failures; (5) delay or inability to access or use the KONEK Service or Interac Direct, including any charges such as late fees or additional interest you may have to pay to a third party (including any merchant); (6) inaccuracy, interception, review or alteration by others of any unsecured communications; (7) suspension or termination of your access to the KONEK Service or Interac Direct by us under Changes to these Terms (section 12); or (8) content you access after leaving our website or our apps including any third party’s website or app regardless of whether or not that content was accessible from our website or apps.

Without limiting the foregoing, RBC and third party service providers expressly disclaim all warranties with respect to the KONEK Service.

  • Changes to these Terms.

A copy of the Terms will be posted at RBC Konek Terms of Use.

We may change these Terms at any time without telling you first, unless we are required to do so under applicable laws. If we amend these Terms, we will tell you about the amendment in writing by posting a revised version at RBC Konek Terms of Use or by such other method as we may decide to use. By continuing to use the KONEK Service , you are agreeing to such changes. The date of the most recent change to these Terms is shown at the top of these Terms. If you do not accept a change to these Terms, you must remove all RBC Payment Methods from, and cease using them through, the KONEK Service.

Your removal of an RBC Payment Method from the KONEK Service does not result in the cancellation or termination of that Payment Method (and associated account with that Payment Method). You may remove an RBC Payment Method from the KONEK Service by following the applicable procedures for removal or closure of Payment Methods at konek.ca. Please allow time to process that request as it may take up to 72 hours.

All disputes between you and a merchant or other party, including your rights to compensation or any rights of set-off, shall be settled directly by you with the applicable Vendor. We do not verify, nor are we required to verify, that any purpose for which the payment is made has been fulfilled by the Vendor as a condition of honouring your payment request on your account.

For eligible RBC Visa credit cards, eligible RBC Mastercard credit cards or RBC Virtual Visa Debit: In some circumstances, we may be able to provide you with assistance to resolve disputed transactions. If a problem with any of the foregoing is not resolved to your satisfaction, please refer to the Account Documents.

For Interac Direct: If your dispute is in relation to a payment made using Interac Direct and you are unable to resolve your issue directly with the Vendor, you may file a claim with us by making a formal request to resolve the dispute. Please note that the disputed transaction must be showing as posted to your eligible personal chequing account before a claim can be made. Please refer to the Interac Direct Client Agreement.

Using Interac Direct as an online payment method means that you have received and read this Agreement and agree to its terms. You will use Interac Direct according to the terms of this Agreement and any other terms or conditions that we may advise you of from time to time. These terms and conditions are a legal agreement between you and RBC.

References in this Agreement to the KONEK Service or Interac Direct includes features, functionality, and services that are either currently available or to be available in the future. Any changes to the KONEK Service may result in a corresponding change to Interac Direct.

References in this Agreement to Account may be subject to change at the sole discretion of RBC.

  • Using the KONEK Service and Interac Direct

To pay using Interac Direct with an Eligible Merchant, you must select KONEK at checkout, select RBC as your preferred financial institution, sign in using your Online Banking credentials, provide consent, and select Interac Direct and your preferred Account to complete your purchase. Your login credentials won’t be shared with KONEK or the Eligible Merchants.

By using Interac Direct as a payment method in the KONEK Service, you are also agreeing to any third-party terms and conditions of use that apply to your use of the KONEK Service with Interac Direct, such as agreements you may have with your wireless carrier and agreements you may have with Eligible Merchants.

Interac Direct can only be used as a payment method when you use the KONEK Service provided by Interac.

  • Responsibility for Interac Direct

Interac is the provider of Interac Direct. Interac is solely responsible for its use and function. We are not responsible for any failure of any Interac Direct service or your inability to use Interac Direct. We are also not responsible for any loss, injury or inconvenience you suffer as a result of using Interac Direct.

  • Purposes of using Interac Direct

You can use Interac Direct through the KONEK service for any purpose we agree to, including:

    • Paying for goods and services made online or through electronic or mobile applications directly from your Account with an Eligible Merchant.
    • Setting up recurring pre-authorized payments from your Account.

You may not use Interac Direct for any illegal, improper or unlawful purpose. We reserve the right to prevent Interac Direct from being used for certain types of transactions as determined by us, including but not limited to, transactions connected to Internet gambling and crypto payments.

  • Interac Direct Debit Transactions

When you choose Interac Direct as a payment method:

    • The purchase transaction is immediately posted to your Account and funds will be debited from your Account, or a pre-authorization is made on your Account at the time of the purchase and available funds will be placed on a hold.
    • This process is followed by a settlement, typically 7 days after authorization, which finalizes the amount of the purchase and, in some cases, reflects adjustments to the initial pre-authorization amount.

If the final settlement amount exceeds your Account balance, your Account will be overdrawn, and overdraft interest charges will apply as described in the section entitled “Overdraft Protection” of the Account Disclosures. However, the overdraft handling fee will not apply.

  • Recurring Payments

You are responsible for any recurring payments you have authorized an Eligible Merchant to debit from your Account, even after you or we cancel this Agreement. If you wish to discontinue any such payments, you must contact the Eligible Merchant in writing and then check your monthly statements to ensure that the payments have, in fact, been discontinued. If they have not stopped despite your instructions to the Eligible Merchant, we may be able to assist you if you provide us with a copy of your written request to the Eligible Merchant.

  • Service Charges

We do not currently charge you any fees when you use Interac Direct, however, other Account fees may apply, as provided in the Account Disclosures.

Other third parties such as wireless companies or data service providers may charge you service fees in connection with your use of your electronic or mobile device and they are not reimbursable by RBC.

  • Setting Limits

We will set one or more limits that will apply to your use of Interac Direct. We may change any of these limits, with or without notice to you. Interac Direct daily limits are shared with the Virtual Visa Debit transactions. It is your responsibility to check your daily transaction limits from time to time in Online Banking or by contacting us. If your use of your Virtual Visa Debit or Interac Direct will cause you to exceed the daily limit on your Account, you will be unable to use Interac Direct to complete the transaction.

  • Protecting your Interac Direct Activity

Regularly check your Account activity in RBC Online Banking or your Account statements and balances to verify all transactions have been properly recorded. If entries do not accurately reflect your transaction activities, such as missing or additional transactions, you should contact us immediately.

  • Protection Against Unauthorized Use

No one but you is permitted to know or use any of your security codes such as passwords, access codes, account numbers, or all other credentials (“Credentials”) that may be used or required for online or mobile transactions. If someone uses your Credentials to make a purchase, you will be fully responsible for all charges incurred in connection with such use except in cases of fraudulent or unauthorized use. You will not be responsible for transactions made with your Credentials as a result of the fraudulent and unauthorized use provided that you (i) are able to establish to our reasonable satisfaction that you have taken reasonable steps to protect your Credentials against loss and theft, (ii) cooperate fully with our investigation and (iii) did not contribute to the unauthorized use of your Credentials. “Unauthorized use” means use by a person other than you who does not have actual, implied or apparent authority for such use and from which you do not receive any benefit.

For greater certainty, you are responsible for all authorized use of your Credentials required to use Interac Direct including, without limitation, if any losses result from these situations:

    • you authorize someone else to use your Credentials, or
    • you make an error when making a purchase transaction using Interac Direct.

Provided that you cooperate fully in any investigation that we or the public authorities may conduct regarding any unauthorized use of your Credentials, you are not liable for:

    • losses which occur because you have been the victim of fraud or theft
  • Your Liability may Exceed your Account Balance

Your liability for losses may exceed your Account balance or available funds if the Account has overdraft protection, the Account is linked to an account that does or if the final settlement amount of an Interac Direct transaction exceeds your Account balance as described above under “Interac Direct Debit Transactions”.

  • Verification and Records

If you contact us to report an unauthorized transaction where your Credentials have been used or an unauthorized Interac Direct transaction, we will respond to you as soon as possible to inform you of our decision as to whether or not we hold you responsible. During this time, we will not unreasonably restrict your access to funds that are the subject of the dispute.

Our records showing the use of Interac Direct and our determination of the details of that transaction will be considered correct and binding on you, unless you tell us in writing of any mistakes. You must tell us of any mistakes within 30 days of the date of a disputed transaction or such longer time period as may be required by an agreement between you and us for the operation of the Account to which the mistake relates.

  • Limitation of Liability and Indemnities

Read this carefully - it limits your right to sue us. IN NO EVENT ARE WE RESPONSIBLE FOR ANY LOSSES WHATSOEVER RESULTING FROM YOUR USE OF INTERAC DIRECT.

We are not responsible for problems you have with anything you buy using Interac Direct. You must settle any such problems directly with the Eligible Merchant, including any merchandise returns. We will not be liable to you for damages (including special, indirect or consequential damages) if you cannot use Interac Direct for any reason including where we decline to authorize a transaction because we have detected activity in your Account that we consider to be unusual. We are not responsible for an Eligible Merchant’s posting practices or any late fees of interest penalties the Eligible Merchant charges you.

No Liability Unless we are Negligent: We will not be liable for any loss, damage, delay or inconvenience to you in connection with the terms of this Agreement, Interac Direct or any instructions provided in connection with Interac Direct. The only exception to this is if we are negligent as compared to reasonable commercial standards, subject to the exclusions set out below. For clarity, nothing in this section affects Our Responsibility for Unauthorized Transactions.

No Liability Even if we are Negligent: We will not be liable to you, even if we are negligent, for any loss, damages, delay, or inconvenience to you for any: (1) losses related to your failure to do something, including a failure to meet your obligations under these terms; (2) mistakes, errors, omissions, inaccuracies or other inadequacies of, or contained in any data or information, including as a result of a failure to update data or information; (3) actions or failures to act by any third party; (4) delay, error, interruption or failure by us to perform or fulfill any of our obligations to you due to any cause beyond our control, any system malfunctions or any technical failures; (5) delay or inability to access or use Interac Direct, including any charges such as late fees or additional interest you may have to pay to a third party (including any merchant); (6) inaccuracy, interception, review or alteration by others of any unsecured communications; (7) suspension or termination of your access to Interac Direct by us under Changes to these Terms (see below); or (8) content you access after leaving our website or our apps including any third party’s website or app regardless of whether or not that content was accessible from our website or apps.

This limitation of our liability applies even if we were advised of the possibility of such damages or losses. This limitation of our liability includes loss of profits, data, information, opportunity, revenues, goodwill or any other commercial or economic loss, and damages in the form of incidental, indirect, consequential, special, aggravated, punitive, exemplary or similar damages, or damages for business interruption.

Release/Indemnities: Except with respect to claims, costs and liabilities arising because of our negligence, you will release and indemnify us and any other person for any claim, cost and liability incurred as a result of your access to or use of Interac Direct or your breach of these terms.

We may change these terms at any time without telling you first, unless we are required to do so under applicable laws. By continuing to use Interac Direct, you are agreeing to such changes. The date of the most recent change to these terms is shown at the top of this Agreement.
